Agreement to Terms

By accessing or using the Ocean County Sod website (oceancountysod.com) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

Services Provided

Ocean County Sod provides professional lawn and landscaping services, including but not limited to:

  • Sod installation (premium and standard)
  • Artificial turf installation
  • Irrigation system design and installation
  • Topsoil and mulch delivery and installation
  • Privacy trees and landscaping
  • Snow removal services
  • Lawn renovation and repair

Quotes and Estimates

All quotes and estimates provided by Ocean County Sod are:

  • Free of charge and provided without obligation
  • Valid for 30 days from the date of issue unless otherwise stated
  • Based on information provided by the customer and site conditions at the time of assessment
  • Subject to change if site conditions differ from initial assessment or if customer requirements change

Final pricing will be confirmed in writing before work begins. Customer acceptance of a quote constitutes agreement to proceed with the work at the stated price.

Payment Terms

Payment terms are as follows:

  • A deposit may be required before work begins, typically 25-50% of the total project cost
  • Final payment is due upon completion of work unless otherwise agreed in writing
  • We accept cash, check, credit card, and bank financing (where available)
  • Late payments may incur interest charges at the rate of 1.5% per month (18% annually)
  • Financing options are subject to credit approval through our third-party partners

Scheduling and Delays

We strive to complete projects within the estimated timeframe. However, project timelines may be affected by:

  • Weather conditions (rain, extreme heat, freezing temperatures)
  • Material availability or supply chain delays
  • Unforeseen site conditions (underground utilities, poor soil conditions, etc.)
  • Customer-requested changes or delays

We will notify customers promptly of any delays and work to minimize disruption. Ocean County Sod is not liable for delays caused by circumstances beyond our reasonable control.

Warranty and Guarantees

Asset Protection Plan

Our Asset Protection Plan plan covers sod installation work against defects in workmanship and materials, subject to the following conditions:

  • Customer must follow our recommended maintenance and watering schedule
  • Coverage applies to the original property owner only and is non-transferable
  • Damage caused by neglect, improper maintenance, pests, disease, or acts of nature is not covered
  • We reserve the right to inspect the lawn before honoring warranty claims

100% Satisfaction Guarantee

If you are not satisfied with our work, please notify us within 7 days of project completion. We will work with you to address any concerns and make reasonable efforts to resolve issues to your satisfaction.

Customer Responsibilities

Customers are responsible for:

  • Providing accurate information about property conditions and requirements
  • Ensuring access to the work area, including unlocking gates and removing obstacles
  • Marking or identifying underground utilities, sprinkler lines, and other buried infrastructure
  • Securing pets and ensuring a safe work environment for our crew
  • Following aftercare instructions provided by Ocean County Sod
  • Maintaining proper watering and lawn care after installation

Cancellation and Refunds

Cancellation policies are as follows:

  • Customers may cancel a project at any time before work begins with full refund of any deposit
  • If work has already begun, refunds will be prorated based on work completed and materials purchased
  • Ocean County Sod reserves the right to cancel a project if site conditions are unsafe or if customer fails to meet their responsibilities
  • Cancellations must be submitted in writing (email or written notice)

Limitation of Liability

To the fullest extent permitted by law, Ocean County Sod's liability for any claim arising from our services is limited to the amount paid by the customer for the specific service in question. We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, loss of use, or property damage not directly caused by our negligence.

Intellectual Property

All content on the Ocean County Sod website, including text, images, logos, and graphics, is the property of Ocean County Sod or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

Dispute Resolution

In the event of a dispute arising from these Terms of Service or our services:

  • Parties agree to first attempt to resolve the dispute through good-faith negotiation
  • If negotiation fails, parties agree to mediation before pursuing litigation
  • Any legal action must be brought in the courts of Ocean County, New Jersey
  • These Terms are governed by the laws of the State of New Jersey

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the modified terms.

Severability
